PREAMBLE

ALCOHOL ABUSE IS DANGEROUS FOR YOUR HEALTH AND SHOULD BE CONSUMED IN MODERATION.

The sale of wines from the alenti.fr and alenti.co websites is exclusively reserved for adults on the date of the order, which the Customer expressly declares and guarantees. 

The sale and supply of alcohol to minors is prohibited.

ARTICLE 1 - SCOPE OF APPLICATION

These General Terms and Conditions of Sale (hereinafter referred to as "GTC") apply, without restriction or reservation, to all sales of wines packaged in Bag-in-Box (hereinafter referred to as "Products") on the e-commerce sites www.alenti.fr and www.alenti.co (hereinafter referred to as "the Site") for mainland France to consumers and non-professional customers (hereinafter referred to as "Customers" or "the Customer") by the publishing company ALENTI SAS (hereinafter referred to as "the Seller").

The main characteristics of the Products are presented on the Site. The Customer is required to read them before placing any order. The selection and purchase of a Product are the sole responsibility of the Customer.

These T&Cs are accessible at any time on the Site and will prevail over any other document.

These General Terms and Conditions are written in French. Only this version is authoritative, regardless of any translations made.

The T&Cs will be executed and interpreted in accordance with French law.

Unless proven otherwise, the data recorded in the Seller's computer system constitutes proof of all transactions concluded with the Customer.

ARTICLE 2 - PRODUCTS AND AVAILABILITY

2.1 Product characteristics

The Products governed by these General Terms and Conditions are white, red and rosé wines, packaged in Bag-in-Boxes of the same volume (3L), listed on the Site.

The photographs and descriptions of the Products presented on the Site are as faithful as possible but cannot ensure perfect similarity with the Product offered for sale, in particular with regard to the colors and visual appearance of the packaging which may vary from one screen to another.

2.2 Product availability

Product offers are subject to availability. If a Product is unavailable after an order has been placed, the Customer will be informed by email and will have the choice between:

  • Reimbursement of amounts paid for the unavailable Product

  • Exchange with a Product of equivalent value

  • Maintaining the order with an extended delivery time if restocking is possible within a reasonable timeframe

ARTICLE 3 - PRICES

The Products are supplied at the current prices shown on the Site when the Seller places the order. Prices are expressed in Euros, inclusive of all taxes.

The prices take into account any reductions that may be granted by the Seller on the Site.

These prices are firm and not subject to revision during their period of validity, as indicated on the Site, the Seller reserving the right, outside the period of validity, to modify the prices at any time.

Prices do not include processing, shipping, transport and delivery costs, which are charged in addition, under the conditions indicated on the Site and calculated prior to placing the order.

ARTICLE 4 - PAYMENT CONDITIONS

4.1 Payment methods

The price is payable in cash, in full on the day the order is placed by the Customer, according to the following terms:

  • By bank cards: Visa, MasterCard, American Express and other bank cards

  • Through Apple Pay, Google Pay, and Shop Pay.

Regardless of the payment method used, the Customer guarantees that he/she is the holder of the payment method, that he/she is fully authorized to use it to pay for his/her order and that this payment method provides access to sufficient funds to cover the full price of his/her order, costs resulting from the use of the services offered on the Site.

4.2 Payment security

Payments made by credit card are secured by [name of secure payment system] which uses an SSL (Secure Socket Layer) encryption protocol to protect all data relating to personal information and payment methods.

The Seller reserves the right to suspend any order processing in the event of refusal of authorization of payment by bank card by officially accredited organizations.

4.3 Failure to comply with payment conditions

The Seller reserves the right, in the event of non-compliance with the payment conditions set out above, to suspend or cancel the delivery of current orders placed by the Customer.

The Seller also reserves the right to refuse to make a delivery or to honor an order if the Customer has not fully or partially paid for a previous order or with whom a payment dispute is being administered.

ARTICLE 5 - ORDERS

5.1 Placing an order

It is up to the Customer to select the Products he wishes to order on the Site, according to the following terms:

  1. Product selection and addition to cart

  2. Validation of the contents of the basket

  3. Identification on the Site or creation of a customer account

  4. Mandatory verification of minimum legal age (18 years)

  5. Validation of delivery information

  6. Choice of delivery method

  7. Acceptance of the T&Cs (check box)

  8. Payment validation

5.2 Order Confirmation

Contractual information will be confirmed by email at the latest at the time of delivery or, failing that, to the delivery address indicated when ordering.

The validation email sent by the Seller to the Customer at the end of the order materializes the acceptance by the Seller of said order, and forms the sales contract between the Parties. Consequently, the sale of the Products from the Site is only deemed complete once the order has been expressly accepted by the Seller.

5.3 Order modification

Any modification of the order by the Customer after confirmation of the order is subject to acceptance by the Seller.

The Seller reserves the right to make modifications to the ordered Product which are linked to technical developments under the conditions provided for in article R.212-4 of the Consumer Code.

ARTICLE 6 - DELIVERY

6.1 Delivery address

The Customer must clearly indicate all information relating to delivery at the time of ordering, in particular:

  • the exact delivery address

  • any access code to the delivery address

  • a landline or mobile phone number

Neither the Seller nor the transport company can be held responsible for an inability to deliver due to an inaccuracy or error in the delivery address. The Customer is required to verify the information they provide. The Customer undertakes to be present at the time of delivery of the order.

6.2 Delivery time and area

The Products ordered by the Customer will be delivered in mainland France within 3 to 5 working days from the dispatch of the order, to the address indicated by the Customer when ordering on the Site.

These delivery times are indicative.

The Seller delivers via its Site only in Metropolitan France (no deliveries to Corsica or the French Overseas Territories).

6.3 Delay in delivery

In the event of a delay in delivery exceeding 30 days from the date initially set, the Customer may request cancellation of the sale under the conditions set out in Articles L.216-2 and L.216-3 of the Consumer Code.

The sums paid by the Client will then be returned to him no later than fourteen (14) days following the date of termination of the contract, excluding any compensation or withholding.

6.4 Order verification

The Customer is required to check the condition of the Products delivered. He has a reasonable period of three (3) days from delivery to make complaints by email or post, accompanied by all relevant supporting documents (photos in particular). After this period and if these formalities have not been complied with, the Products will be deemed compliant and free from any apparent defect and no complaints may be validly accepted by the Seller.

6.4 Transfer of risks

The transfer of risks of loss and deterioration of the Products will take place at the time when the Customer, or a third party designated by him, takes physical possession of the Products, without distinction according to the nature of the carrier.

ARTICLE 7 - RIGHT OF WITHDRAWAL

7.1 Time limit and terms of withdrawal

In accordance with the legal provisions in force, the Customer has a period of fourteen (14) days from receipt of the Product to exercise his right of withdrawal from the Seller, without having to provide reasons or pay a penalty.

To exercise his right of withdrawal, the Customer must notify his decision to withdraw by means of an unambiguous declaration (for example, letter sent by post or email) to Alenti SAS, 73 Allée Kléber 34000 Montpellier or hello@alenti.fr.

7.2 Exceptions to the right of withdrawal

In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal cannot be exercised for:

  • Products likely to deteriorate or expire rapidly

  • Products that have been unsealed by the Customer after delivery and which cannot be returned for reasons of hygiene or health protection

7.3 Return of products

If the right of withdrawal is exercised within the aforementioned period, the price of the Product(s) purchased and the delivery costs will be refunded, with the return costs remaining the responsibility of the Customer.

The return of the Products must be made in their original packaging and in perfect condition within fourteen (14) days following notification to the Seller of the Customer's decision to withdraw.

7.4 Reimbursement

The refund will be made using the same means of payment as that used for the initial transaction, unless the Customer expressly agrees to another means. This refund will not incur any costs for the Customer.

The refund will be made within fourteen (14) days of receipt of the Products returned by the Customer under the conditions provided above.

ARTICLE 8 - SELLER'S LIABILITY - GUARANTEE

8.1 Legal guarantees

The Products sold on the Site comply with the regulations in force in France and benefit from:

  • From the legal guarantee of conformity mentioned in articles L.217-4 to L.217-14 of the Consumer Code

  • On the guarantee of hidden defects mentioned in articles 1641 to 1649 of the Civil Code

8.2 Storage and conservation conditions

The Seller shall not be held liable for any deterioration of the Products resulting from improper storage conditions after delivery. The Customer is informed that Bag-in-Boxes must be kept:

  • Sheltered from the heat

  • Protected from direct light

  • In a dry environment

  • Preferably in a horizontal position or with the tap facing down

  • At a constant temperature between 10°C and 20°C

8.3 Shelf life after opening

Once opened, the Bag-in-Box allows the wine to be stored for a period of 4 to 8 weeks depending on the type of wine, under normal storage conditions. Beyond this period, the Seller cannot guarantee the organoleptic quality of the Product.

ARTICLE 9 - SALE OF ALCOHOL

9.1 Age Verification

In accordance with Article L.3342-1 of the French Public Health Code, the sale of alcohol to minors under the age of eighteen (18) is prohibited. By placing an order on the Site, the Customer undertakes to have reached the legal age of eighteen (18) years on the date of the order. The Seller reserves the right to request proof of identity at the time of delivery.

9.2 Alcohol abuse

The Seller reminds you that alcohol abuse is dangerous for your health and that the Products must be consumed in moderation.

ARTICLE 10 - INTELLECTUAL PROPERTY

The content of the Site is the property of the Seller and is protected by French and international intellectual property laws. Any total or partial reproduction of this content is strictly prohibited and may constitute an infringement of copyright.

ARTICLE 11 - PERSONAL DATA

11.1 Collection and processing of data

The personal data collected from Customers is subject to computer processing by the Seller. This data is recorded in the Seller's Customer database and is essential for processing the order and managing the business relationship. This information and personal data is also retained for security purposes and to comply with legal and regulatory obligations.

11.2 Purposes of processing

Personal data is collected for the following purposes:

  • Order and delivery management

  • Billing

  • After-sales service

  • Commercial communication (with prior consent)

  • Legal and regulatory obligations

11.3 Rights of individuals

In accordance with Regulation (EU) 2016/679 on the protection of personal data, the Client has the following rights over their data: right of access, right of rectification, right to erasure, right to restriction of processing, right to portability. The Client may also define the guidelines regarding the fate of their data after their death.

11.4 Retention period

The data is kept for a period not exceeding that necessary for the purposes for which it is processed and in any event in accordance with the legal retention periods.

ARTICLE 12 - FORCE MAJEURE

The performance of the Seller's obligations hereunder shall be suspended in the event of the occurrence of a fortuitous event or force majeure which would prevent its performance. The Seller shall notify the Customer of the occurrence of such an event as soon as possible.

ARTICLE 13 - APPLICABLE LAW - LANGUAGE

These General Terms and Conditions and the transactions resulting from them are governed by French law. They are written in French. In the event that they are translated into one or more languages, only the French text shall be authoritative in the event of a dispute.

ARTICLE 14 - DISPUTES

14.1 Complaints

For any complaints, the Customer can contact the Seller's customer service at the following address: hello@alenti.fr , by instant messaging on the Site, or by mail to ALENTI, Customer Service, 73 Allée Kléber 34000 Montpellier.

14.2 Mediation

If the complaint request to customer service fails or if there is no response within two months, the Customer may submit the dispute to a mediator who will attempt, in complete independence and impartiality, to bring the parties together with a view to reaching an amicable solution.

In accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, the Customer may use the following mediation service: CM2C, 49 rue de Ponthieu, 75008 Paris, contact@cm2c.net - 01 89 47 00 14

14.3 Competent jurisdiction

In the absence of an amicable agreement, the Client may refer any dispute relating to the existence, interpretation, conclusion, execution or termination of the contract and all documents related to this contract to the court.

ARTICLE 15 - PRE-CONTRACTUAL INFORMATION - CUSTOMER ACCEPTANCE

The Customer acknowledges having received, prior to placing his order, in a legible and comprehensible manner, these General Terms and Conditions and all the information and details referred to in Articles L.111-1 to L. 111-8 of the Consumer Code.

By placing an order on the Site, the Customer acknowledges having read these General Terms and Conditions and declares that they accept them without reservation.
